Terms and Conditions
Sale of goods via 314oneer.ch
1. Scope
These terms apply to all orders of goods (for example the Team Kit) placed on the website 314oneer.ch between Pirmin Loetscher, 3.14ONEER, Sonnweid 7, CH-6280 Hochdorf (“we”) and the customer. For custom builds, assembly and consultation, the conditions agreed in the relevant quote apply; these terms apply in addition.
2. Conclusion of contract
The presentation of items on the website is not a binding offer. By submitting an order the customer makes a binding offer. We confirm receipt of the order automatically by email; this is not yet an acceptance. The contract is concluded when we confirm the order by email or deliver the goods.
3. Prices
All prices are in Swiss francs (CHF). We are not subject to value added tax, so no VAT is shown. Shipping within Switzerland is included in the price of the Team Kit; any other shipping costs are communicated to the customer before the contract is concluded.
4. Availability and pre-orders
Items marked “In stock” are delivered from existing stock. Sizes that are out of stock can be pre-ordered. We obtain pre-ordered items from the manufacturer (Q36.5). We confirm the delivery time to the customer individually by email; it may take longer. Until that confirmation the customer can cancel the pre-order free of charge. If an item cannot be delivered, we inform the customer immediately and refund amounts already paid.
5. Payment
Payment is made online by TWINT or credit card through the payment provider Stripe, or by invoice by arrangement. We do not receive card data. Items in stock are paid for with the order. For pre-ordered items payment is due after we have confirmed the delivery time and sent the customer a payment link.
6. Delivery
We deliver to the delivery address given by the customer in Switzerland; deliveries abroad are possible on request. We ship items in stock as soon as possible after payment is received. Delivery times are guidelines unless we have confirmed otherwise in writing.
7. Retention of title
Delivered goods remain our property until paid in full.
8. Returns
There is no statutory right of withdrawal for online purchases in Switzerland. We voluntarily grant a 14-day right of return from receipt for unworn and unwashed goods in original condition. Items that we obtained from the manufacturer on the customer’s pre-order are excluded. The customer bears the return shipping costs. We refund the purchase price after receiving and inspecting the goods, by the same means used for payment.
9. Warranty
The statutory warranty of two years from delivery applies. Defects must be reported to us without delay after discovery. At our choice we remedy the defect by repair or replacement or refund the purchase price, unless the law provides otherwise. Minor colour differences between screen, design and product are not a defect.
10. Liability
We are liable as provided by law. To the extent permitted, we exclude liability for slight negligence and for indirect and consequential damage.
11. Data protection
How we process personal data is described in our privacy policy.
12. Governing law and jurisdiction
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is, where permitted, Hochdorf LU; consumers keep the mandatory statutory places of jurisdiction.
13. Final provisions
We may change these terms; an order is governed by the terms published at the time of the order. If a provision is invalid, the others remain valid. The German version prevails; translations are for convenience.
